Terms of Service

Welcome to MyFusion Helper, operated by MyFusion Solutions, LLC ("MyFusion," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the MyFusion Helper platform located at myfusionhelper.ai, including all related services, features, content, and applications (collectively, the "Service").

1. Agreement to Terms

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree with any part of these Terms, you must not use the Service.

2. Description of Service

MyFusion Helper is a subscription-based software-as-a-service (SaaS) platform that extends CRM and business tool automation. The Service provides a suite of 62 automation tools ("Helpers") that extend CRM functionality across Keap, GoHighLevel, ActiveCampaign, Ontraport, HubSpot, and Stripe, including workflow automations, integrations, webhooks, REST hooks, and data management utilities.

The Service also includes AI-powered features that leverage artificial intelligence to assist with content generation, data analysis, and workflow optimization. These AI features are designed to augment your productivity and are subject to the specific terms outlined in Section 6 below.

The Service integrates with third-party platforms including, but not limited to, Keap, Zoom, and other services as made available from time to time. The availability and functionality of these integrations may change without prior notice.

3. Account Registration and Security

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at help@myfusionsolutions.com if you suspect any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that contain inaccurate information, are used in violation of these Terms, or pose a security risk to the Service or other users.

4. Subscription and Billing

The Service is offered through tiered subscription plans: Start ($39/month), Grow ($59/month), and Deliver ($79/month). Each plan includes different feature sets and usage limits as described on our pricing page. All subscription fees are prepaid on a monthly basis.

New accounts are eligible for a 14-day free trial. During the trial period, you may access the features included in your selected plan at no charge. At the end of the trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial expires.

Subscriptions automatically renew at the end of each billing cycle. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds or prorated credits will be issued for unused time. Subscription fees are non-refundable except where required by applicable law.

We reserve the right to change our pricing with 30 days' written notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights, including anti-spam laws such as CAN-SPAM, GDPR, and CCPA.
  • Send unsolicited bulk communications, spam, or messages that violate applicable marketing consent requirements.
  • Transmit malware, viruses, or any code designed to disrupt, damage, or limit the functionality of any software or hardware.
  • Attempt to gain unauthorized access to the Service, other accounts, or any related systems or networks.
  • Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
  • Use the Service to store, process, or transmit content that is unlawful, harmful, threatening, defamatory, or otherwise objectionable.
  • Use the AI features to generate content that is deceptive, misleading, fraudulent, or designed to impersonate another person or entity.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the Service.
  • Resell, sublicense, or redistribute access to the Service without our prior written consent.

We reserve the right to investigate and take appropriate action against violations of this policy, including suspension or termination of your account.

6. AI-Powered Features

The Service includes features that utilize artificial intelligence and machine learning technologies ("AI Features"). These AI Features may assist with content generation, workflow suggestions, data analysis, and other tasks designed to enhance your use of the platform.

No guarantee of accuracy. AI-generated content and suggestions are provided for informational and productivity purposes only. AI outputs may contain errors, inaccuracies, or omissions. We do not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated output for any particular purpose.

User responsibility. You are solely responsible for reviewing, verifying, and approving all AI-generated content before using it in your business operations, communications, or any other context. You should not rely on AI outputs as a substitute for professional judgment, legal advice, financial guidance, or any other expert counsel.

Data processing by AI providers. To provide AI Features, certain data you input or that is associated with your account may be transmitted to third-party AI service providers for processing. We select AI providers that maintain appropriate security and confidentiality standards. Please refer to our Privacy Policy for details on how your data is handled in connection with AI Features.

AI output ownership. Subject to your compliance with these Terms, you retain ownership of the content you create using AI Features. However, you acknowledge that similar or identical outputs may be generated for other users and that AI outputs are not guaranteed to be unique.

7. Third-Party Integrations

The Service integrates with third-party platforms and services, including Keap, Zoom, and others. Your use of these integrations is subject to the respective terms of service and privacy policies of each third-party provider. You are responsible for reviewing and complying with those terms.

We do not control and are not responsible for the availability, accuracy, or content of any third-party service. We make no representations or warranties regarding third-party integrations, and any issues arising from your use of a third-party service should be directed to that provider. Changes to third-party APIs or services may affect the functionality of our integrations, and we are not liable for any resulting disruptions.

8. Intellectual Property

The Service, including its software, design, text, graphics, logos, icons, and all other content and materials (collectively, "MyFusion Content"), is owned by MyFusion Solutions, LLC and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable right to access and use the Service in accordance with these Terms. No other rights are granted, whether by implication, estoppel, or otherwise.

"MyFusion Helper," "MyFusion Solutions," and related logos and marks are trademarks of MyFusion Solutions, LLC. You may not use our trademarks without our prior written permission.

9. Data Ownership and Portability

You retain all rights, title, and interest in and to the data you submit to or generate through the Service ("Your Data"). We do not claim ownership of Your Data. By using the Service, you grant us a limited license to use, process, and store Your Data solely to the extent necessary to provide and improve the Service.

Upon request, and subject to technical feasibility, we will make Your Data available for export in a standard, machine-readable format. After termination of your account, we will retain Your Data for a limited period as described in Section 12 to allow for retrieval, after which it may be permanently deleted.

10. Limitation of Liability

To the maximum extent permitted by applicable law, MyFusion Solutions, LLC and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of or inability to use the Service.

Our total aggregate liability for all claims arising out of or related to these Terms or the Service shall not exceed the total amount you paid to us during the six (6) months immediately preceding the event giving rise to the claim. This limitation applies regardless of the theory of liability, whether in contract, tort, strict liability, or otherwise.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components. We do not warrant or make any representations regarding the accuracy or reliability of any AI-generated outputs or the results of using the Service.

12. Termination

You may terminate your account at any time by canceling your subscription through your account settings or by contacting us at help@myfusionsolutions.com. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. We will make Your Data available for export for thirty (30) days following termination, after which we may permanently delete it.

Sections of these Terms that by their nature should survive termination (including, without limitation, Sections 8, 10, 11, and 13) shall survive any termination or expiration of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Tampa, Florida. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, collective action, or representative action. Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property rights.

14. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Effective Date" above. We may also notify you via email or through an in-app notification. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
